Please read these Terms & Conditions carefully. By making a booking with Tour Operator ("we", "us", "our"), you agree to be bound by these terms on behalf of yourself and all members of your party.

1. Bookings & Payment

All bookings are subject to availability. Bookings are confirmed only after full payment has been received and a confirmation number issued. Prices are quoted in US dollars and include applicable taxes unless stated otherwise. We reserve the right to correct pricing errors at any time.

2. Cancellations & Refunds

Cancellation requests must be submitted at least 24 hours before the scheduled departure to be eligible for a refund. A cancellation fee may apply; the exact amount will be shown when you submit a cancellation request and is calculated using the rate set in our Cancellation Policy.

No refund will be issued for no-shows, late arrivals that miss the departure, or cancellations made within 24 hours of departure, unless we cancel the trip ourselves.

3. Weather, Safety & Operational Changes

The captain has sole and final authority over departure, return, route, and any decision to cancel, shorten, or modify a trip for safety reasons (including but not limited to weather, sea conditions, mechanical issues, or crew judgement). If we cancel a trip in advance for operational or weather reasons, you will be offered a reschedule or a full refund.

4. Health, Fitness & Disclosure

You confirm that all participants are in adequate physical condition to participate in the booked activity, can swim (for water-based tours), and have disclosed in writing any medical conditions, pregnancy, or recent injuries that may affect their participation. The captain may at their discretion refuse boarding to any passenger who appears unfit, intoxicated, or under the influence of drugs.

5. Liability & Waiver

Participation involves inherent risks including drowning, marine-life encounters, slips and falls, equipment failure, sun exposure, and physical exertion. Each lead booker will be required to sign an electronic Liability Waiver on behalf of all passengers. You participate at your own risk. To the maximum extent permitted by Cayman Islands law, we are not liable for personal injury, illness, loss, or property damage incurred during your tour, except where caused by our gross negligence or wilful misconduct.

6. Children & Minors

Children under 18 must be accompanied by a parent or legal guardian who signs the Liability Waiver on their behalf. Minimum-age requirements may apply for specific activities at the captain's discretion.

7. Photography & Photo Packages

Onboard photographers may capture images during your tour. Optional photo packages are sold as add-ons and are non-refundable once delivered. Photos are delivered via AirDrop or shared link and are licensed for personal, non-commercial use. We may use anonymised tour photos in our marketing unless you opt out in writing before the tour.

8. Conduct

You agree to follow crew instructions at all times and respect other guests, crew, and marine wildlife. We reserve the right to remove from the boat any guest behaving dangerously or disrespectfully without refund.

9. Discount Codes

Discount codes are subject to the conditions shown at the time of issue (validity dates, usage caps, applicable tours). Codes have no cash value, are not transferable, and may be revoked or modified at our discretion in cases of fraud or misuse.

10. Changes to These Terms

We may update these terms from time to time. The version in effect at the time of your booking applies to that booking. Continued use of our services after changes are posted constitutes acceptance.

11. Governing Law & Jurisdiction

These terms are governed by the laws of the Cayman Islands. Any disputes will be subject to the exclusive jurisdiction of the courts of the Cayman Islands.
